A networking site for Radio advertising sales professionals.

In Colorado we are seeing a growth in Marijuana Dispensaries. Although these pot shops are legal by state law, it is still against federal law. Our lawyers are reluctant to let us sell commercial time to these businesses, due to the fact that we are regulated by the FCC, but these businesses have deep pockets for advertising. Does anyone have experience with advertising, or have any legal experiece handling this sticky issue?

I guess I would ask my self one question. That question is, how would I answer the judge when he asks me: "Mr. Rolando, were you aware that it is against Federal Law to to purchase this product, and if you were, why did you think it was legal for you to aid in its sale?". Based upon that, I'd pass.

Yes, these people do have deep pockets but before you decide to "mine that money" so to speak, I recommend you watch the documentary "Pot City, USA" which just aired on A&E. I don't think after seeing this show that any radio professional would want to promote the sale of marijuana even if it is legal in that state. I just don't think it is worth a stations reputation to promote marijuana dispensaries while also doing PSA's for DARE, MADD etc. It just sends a mixed message that offends people.
