HoJo, I don't think it's illegal to use the word "cigarette." It's the advertising of cigarettes containing tobacco that is illegal. As far as I know, it's OK to advertise these new e-cigarettes as long as you specify they are non-tobacco. Might also be a good idea to say something like "a safer alternative to cigarettes." There are stations advertising these already and I saw one attorney's opinion that it was OK.
Good info, DJ. Any chance you can send me the link where you found the info on the FCC website, especially for line 2? I'm having a heck of a time find it.
weirdly, when I searched the fcc site for e-cigarettes, I get "your search yielded no results". That's why I asked if you had a link as I need something to show my client what the rules and regs are. I have yielded very little information from my search efforts and haven't at all run across the "safer alternative" rule. I'll keep looking though!
